Policies The terms, policies and conditions (collectively known as "Conditions") described below govern the use of this site (referred to as "MamaJuana Energy" or "Site"). Customer use and/or placement of any order indicates your (referred to as “Customer”) acceptance of these Conditions. Shipping Charges Delivery Exceptions (wrong addresses): Customer agrees to pay additional fee of $5.50 per delivery exception (wrong or incorrect shipping address) if said information is provided in error by customer. Customer will be invoiced separately by Layfield Energy, Inc. either directly or via merchant charge to Customer’s credit card. Customer is not responsible for delivery exceptions caused by Layfield Energy, Inc. Package will be delivered upon payment of delivery exception fee. Any shipping and handling charges are not refundable for our services or product. Privacy Layfield Energy, Inc. will not share any personal identifiable information with any third parties for direct marketing purposes unless Customer affirmatively agrees to the disclosure. We keep Customer’s personal information private and secure. When Customer makes a purchase from our site, Customer may be asked to provide name, email address, credit card information, address, phone number, and a password. We use this information to process Customer orders, to keep Customer updated on Customer orders and to personalize Customer shopping experience. Customer participation and activity (including providing the information noted above) is voluntary, and Customer can choose not to provide certain information, however Customer may not be able to take advantage of some of the Site’s features; including purchases. Our secure servers protect Customer information using advanced encryption techniques and firewall technology. To keep Customer informed about our latest offers, we may notify Customer of current promotions, specials and new additions to the Layfield Energy, Inc. Site. Customer may unsubscribe from our newsletters by following the unsubscribe instructions in any email Customer receive from us. When entering any of our contests or prize drawings, Customer may be asked to provide Customer name, email address and mailing address. If Customer wins, we will send the prize to the address entered and notify Customer by email. When Customer enters a contest or drawing Customer is also included in our newsletter list to receive notice of promotions, specials and new additions to the Site. Customer may unsubscribe from this news list by following the unsubscribe instructions in any email received. Layfield Energy, Inc. may also receive information about Customer from other sources in connection with promotions, contests, sweepstakes, affiliates, or special purchases in connection with a promotion in which Layfield Energy, Inc. is participating that is offered on a third-party site. Said information may be combined with the information we collect on the Site. In those cases, Layfield Energy, Inc. will apply this Privacy Policy to any personally identifiable information received. Layfield Energy, Inc. uses a fulfillment center for the handling, packing and shipping of its orders and the following information will be transmitted electronically via email to complete the order: Name, phone number, email address, shipping address and billing address and product (s) ordered. We may use "cookies" to keep track of Customer current shopping session to personalize Customer experience and so that Customer may retrieve Customer shopping cart at any time. Privacy on Other Web Sites Other sites accessible through our site have their own privacy policies and data collection practices. Please consult each site’s privacy policy. Layfield Energy, Inc. is not responsible for the actions of third parties’ sites. Children and Minors Layfield Energy, Inc. does not want to collect personal information from minors (children under 18 years of age, or any other age defined under applicable law). If we become aware that a minor is attempting to or has submitted personal information via this Site, we will notify the user that we may not accept his or her personal information. We will then expunge any such personal information from our records. Eligibility for Service or Products Our services are eligible and available only to individuals who are of legal age to form legally binding contracts under each applicable state law. If Customer does not qualify, please do not use our services. Any giveaway is limited to people 18 years of age or older. Laws and Regulations Access to and use of this Site, the services and products are subject to all applicable federal, state and local laws and regulations. Order Acceptance Policy Customer receipt of an electronic or other form of order confirmation does not signify our acceptance of Customer order, nor does it constitute confirmation of our offer to sell. Layfield Energy, Inc. reserves the right at any time after receipt of Customer order to accept or decline Customer order for any reason or to supply less than the quantity Customer ordered of any item. Credit Cards We accept the following credit cards: Visa, MasterCard, Discover and American Express. There is no surcharge for using a Customer credit card to make purchases with Layfield Energy, Inc. Please be sure to provide Customer exact billing address and telephone number (i.e. the address and phone number Customer credit card bank has on file for Customer). Incorrect information will cause a delay in processing Customer order. Customer credit card will be billed upon shipment of Customer order. Money Orders, Cashier’s Checks, Company Checks, & Personal Checks Layfield Energy, Inc. accepts money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 10 banking days after receipt for clearance of funds before the order is processed. We cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks. Shipping Policy Because we want Customer to have the best experience while visiting and using our Site, we have selected a major shipping carrier with great dependability and we will ship Customer order via UPS. Said delivery is shipped via ground service in the Continental US only. Shipping may not be available in all areas and it subject to the delivery limitation of UPS. Any shipments with special handling costs associated with the shipping address may result in higher charges solely at the expensive of the customer. Shipping Time Most orders received before 2:00 PM EST will ship the same day, provided the product ordered is in stock. Most orders received after 5:00 PM EST will ship the next business day. Orders are not processed or shipped on Saturday or Sunday, except by prior arrangement. All orders must be shipped to physical business or residential addresses. We reserve the right to not ship to any P.O. Boxes. Customer order may be cancelled if the shipping address is incorrect. We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to Customer by Layfield Energy, Inc. or other parties only as an estimate. However Layfield Energy, Inc. ships its products via UPS Ground with an expected delivery within 5 business days. We encourage Customer to order in a timely fashion to avoid delays caused by shipping or product availability. Out-of-Stock Products We will ship Customer product as it becomes available. Usually, products ship the same day if ordered by 2:00 PM EST, or by the next business day if Customer order is received after this time and for orders received on Saturday, Sunday or any major holiday. However, there may be times when the product Customer has ordered is out-of-stock which will delay order fulfillment. We will keep Customer informed of any products that Customer has ordered that are out-of-stock and unavailable for immediate shipment. Customer may cancel Customer order at any time prior to shipping. Products, services and materials are provided on an “as available” basis and Customer order may be accepted or declined at any time for any reason. Multiple Product Orders For a multiple product orders, we will make every attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available, unless Customer informs us otherwise. Customer will only be charged for products contained in a given shipment, plus any applicable shipping charges. Customer will only be charged for shipping at the rate quoted to Customer on Customer purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order. Taxes Layfield Energy, Inc. shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within AZ. For orders shipped to other states, Customer is solely responsible for all sales taxes or other taxes. Changes Layfield Energy, Inc. reserves the right to modify its services or products at any time by changing information on our Site. This includes the right to discontinue the Site services or products, change the rules of use, and terminate Customer use. Layfield Energy, Inc. does not guarantee continuous, uninterrupted access to our services or products, and operation of our Site may be interfered with by numerous factors outside of our control. Layfield Energy, Inc. may change the terms of use or other policies at any time for any reason. We will post those changes on our site and encourage users to read the “Terms of Use” page frequently. Returns We do not accept returns of product except for returns for fulfillment mistakes that we make resulting in the shipment of incorrect product to Customer. Such returns must be submitted within 30 days from the date of purchase. In such cases only, please return any unused product with sales receipt and we will refund your purchase. Any charges for shipping are not refundable. Our return refund is for products purchased directly through our online store only. All other refunds must be obtained directly from the original store where the product was purchased and are subject to that store’s refund policy. To obtain a refund, please call customer service at (877) 483-2855 in advance to obtain an RMA number (Return Merchandise Authorization). RMA# ____________________ (fill in number) 14950 North 83rd Place, Suite 1 Scottsdale, AZ 85260 Return merchandise must have both a RMA (return merchandise authorization) and a sales receipt. We suggest that Customer returns the product using a service that offers tracking. We are not responsible for lost return items or their postage. Typographical Errors In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Layfield Energy, Inc. shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Layfield Energy, Inc. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and Customer credit card charged. If Customer credit card has already been charged for the purchase and Customer order is canceled, Layfield Energy, Inc. shall immediately issue a credit to Customer credit card account in the amount of the incorrect price Links This site may contain links to other sites on the Internet that are owned and operated by third parties. Customer acknowledges that Layfield Energy, Inc. is not responsible for the operation of or content located on or through any such site.
